HOW TO APPLY FOR A SIDEWALK CAFÉ PERMIT

  APPLICATION

An application must be filed with the City of Spokane, Department of Engineering Services, located on the Third Floor of the Municipal Building, along with an 8-1/2 X 11 inch plan of the proposed sidewalk café showing adjacent buildings, sidewalk dimensions, café dimensions, any street trees in the area, size and placement of tables, curbs, loading zones, alleys, type and profile of the barriers to be used to enclose the sidewalk café and any other obstructions in the area.

FEE

When the application is filed, a $300.00 non-refundable fee must also be paid to the Department of Engineering Services.

 PROCESSING THE APPLICATION

The Department of Engineering Services will review the proposal.  Copies of the application and plan will be sent to all concerned City departments.  Surrounding property owners will be notified and public notices will be posted.

 HEARING

After receiving approval from all departments concerned, a hearing will be set before the Hearing Examiner, at which the public may offer testimony on the permit application.

 REQUIREMENTS

The applicant will be required to maintain table and chair seating not less than 15 square feet per person per seat and limited access to the area by means of rope, chain or similar material with portable pedestals.  Awnings, if any, will be in accordance with Chapter 45, Uniform Building Codes.  Any lighting or other temporary fixtures that are placed within the sidewalk café area will be in accordance with applicable City codes.  The area will be cleared when not in use as a sidewalk café or upon the order of the appropriate City official, and as may be necessary to accommodate deliveries to adjacent or other nearby properties.

INSURANCE & LIABILITY

The applicant must sign an agreement (copy attached) to hold harmless the City of Spokane from any and all claims, liabilities, judgments, costs, damages, and expenses arising from any act which the applicant or the applicant’s agents or employees may do, or allow to be done under this permit; or which may arise from the negligence of the applicant or the applicant’s agents or employees.  The applicant will provide the Department of Engineering Services with liability insurance in the amount of $500,000.00 naming the City as an additional insured.

TEMPORARY PERMIT

This permit, if approved, is temporary only and vests no permanent right.  The City retains the right to revoke the permit with 30 days notice, posted on the premises, or without notice, in case the permitted use becomes dangerous or unsafe.  This permit is valid for one calendar year (January 1 to January 1).  A renewal application must be submitted every year after the initial application and accompanied by a $250.00 renewal fee.
